TERMS AND CONDITIONS

Each purchase transaction is governed by the provisions of Legislative Decree no. 185 of 22/05/1999 "Implementation of Directive 97/7/EC on the protection of consumers in respect of distance contracts" and, as far as the protection of confidentiality is concerned, is subject to the regulations set forth in Legislative Decree no. 196/2003. This contract has as its purpose the purchase and sale of products marketed by www.dominodisplay.com in the quantity and quality chosen by the consumer through computer selection at www.dominodisplay.com From the moment the consumer accesses and uses www.dominodisplay.com, they must review and accept these terms and conditions before confirming purchases from the site. The submission of the order confirmation therefore implies full knowledge and acceptance of the conditions of sale. Therefore, we urge you to read them carefully and print and/or save them on another durable medium of your choice in order to fully comply with the condition in Art. 3 and 4 of Legislative Decree no. 185/1999. The consumer may opt out of accessing or using the website if they do not wish to accept or abide by these terms and conditions.


METHOD OF PURCHASE

Purchases of the products, available as illustrated and described online in the relevant information sheets, are made at the price indicated therein, expressed in euros, excluding VAT. The prices displayed are valid exclusively for Italy. Transportation costs are not included in the price but are displayed separately at the time of purchase. Prior to confirmation of your purchase, you will be given a summary of the unit cost of each product you have chosen, the total cost in the case of multiple products, and the relevant shipping costs. Upon confirming your purchase, you will receive an e-mail message containing the date and total amount of your order and any other details for same.

ORDERS AND BILLING

Orders are accepted by computer selection at www.dominodisplay.com. The conclusion of the contract is subject to the Customer making payment of the full amount by one of the permitted methods of payment. Those obliged to request an invoice must report the VAT no. and all the data necessary for the issue of same. The Tax Invoice may also be issued after delivery of the goods, within the time frame required by law.

PURCHASE AGREEMENT ENTERED INTO BY MINORS

Purchases can only be made by those over 18 years of age. However, should a purchase be made by a minor who has provided false information regarding age, or false directions to purchase the desired item and/or to access the desired data, the parents are directly responsible for payment of the goods purchased without prejudice to the discipline of withdrawal stated in these terms of sale.

METHODS OF PAYMENT

Prices on www.dominodisplay.com are valid for Italy only, are exclusive of VAT, and include containers and packaging. The delivery charge is indicated at the time of purchase. Payment for the purchased products and related shipping costs may be made at the time the order confirmation is submitted, using one of the Credit Cards available and indicated online. Purchasing through the use of a Credit Card involves typing in Card information. DOMINO SISTEMI S.R.L. in order to offer a higher guarantee to its customers uses the secure transaction system developed by PayPal. Credit Card information is collected using SSL (Secure Sockets Layer), the most widely used security protocol, with the primary task of ensuring the confidentiality and reliability of communications between the buyer's computer and the bank's server by encrypting the data. Using this system, the user communicates their credit card information only to PayPal's secure server.

METHOD OF DELIVERY

Shipping is within 5 working days (unless otherwise noted).

For its e-commerce service, DOMINO SISTEMI S.R.L. delivers exclusively in Italy, using specialized Couriers. Purchased products are delivered directly to the address given during the purchase process. Each shipment contains the ordered goods and accompanying documentation. Delivery times may vary depending on the availability of goods. Upon delivery, the Customer is required to check that the package is intact and undamaged. A report must be opened within 7 days of receiving the goods depending on which of the 3 possible situations may have occurred: A) Damaged Packaging (Possible Damaged Monitor inside) B) Undamaged Packaging (Damaged Monitor inside not visible at time of delivery) C) Monitor Failed due to technical malfunction.

Case A: Reject the package or sign the POD to the carrier/courier stating "Packaging not intact, goods accepted with Reservation".

Case B: Sign the POD to the carrier/courier stating "Packaging not intact, goods accepted with Reservation". The box and packaging should always be kept in the best way possible and reused when collecting the goods. In both cases, open a report to the Domino Display Support service, providing:
- Copy of the POD and Confirmation of acceptance with reservation and damaged packaging for case A
- 360° photos of the packaging and Monitor
- Photo of the Monitor and description of the fault found
- Serial Number of the Device
- Invoice / Order Reference
- Reference Person
- Place of Installation

Domino's Support Service will provide you with a Ticket No. and in turn will open a dispute with the distributor/supplier.An RMA procedure will be opened for the return of the damaged device and evaluation with expert opinion by a technician appointed by Samsung Italia.The closure of the dispute by Domino is estimated in about 30 days/45 days from the opening of the ticket with the delivery of a new monitor to replace the previous one.If there is no technical time to wait for the resolution of the dispute, we recommend the reorder of a new monitor for which Domino Sistemi, as soon as there is a positive response to the appraisal, undertakes to reverse the relevant invoice and make a refund of the amount due.

Case C: Defect covered by Samsung warranty (for 3 Years) Open a report to the Domino Display Support service, providing:
- Monitor Photos
- Descriptions and Photos of the Defect Found
- Serial Number of the Device
- Invoice / Order Reference
- Reference Person
- Place of Installation

Domino's Support will open a ticket to handle the dispute and have Samsung Italy Customer Service intervene directly with a warranty claim. Samsung Italy will respond directly whether or not the defect is covered by warranty. Domino's Support will forward you the Ticket number which will be handled directly by Samsung. Closure of the dispute is estimated to be about 15 days. From the opening of the ticket.
Note: All Monitors are covered by a 3-year warranty directly from Samsung Electronics Italia S.p.A. with on site intervention with average timescales in the three working days following (*) the opening of the request to Samsung Electronics Italia S.p.A. B2B Customer Service (*) In some areas or small municipalities the expected timescales may be longer.

Under the On Site (technician at home) mode, Samsung Electronics Italia S.p.A. will not be responsible in any way for costs and responsibilities related to the uninstallation of the monitor that is:
- fixed at a height of more than 1.60 m.
- located within specific furnishings.
- in VideoWall configuration
- 65" or larger in size.
In this case, it is required to have the monitor placed on the ground (either by the end user or a support service must be requested to remove the device).

The warranty does not apply to monitors in which software other than that originally installed by Samsung has been installed (i.e., in cases where this software has only been uninstalled). For more information: www.samsung.com/it/business/support/garanzia

RIGHT OF WITHDRAWAL NOTICE

Right of withdrawal
You have the right to withdraw from the contract, without giving reasons, within 14 days.The withdrawal period expires after 14 days from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the last good. In order to exercise your right of withdrawal, you must inform us (Dominosistemi srl - Via Renolda 37 - Castel Mella (BS) Tel 0302308677 - info@dominodisplay.com) of your decision to withdraw from this agreement by means of an explicit statement (e.g. letter sent by mail, fax or e-mail). You may use the attached model withdrawal form for this purpose, but it is not mandatory.To comply with the withdrawal period, it is sufficient for you to send the notice regarding the exercise of the right of withdrawal before the expiry of the withdrawal period.

Effects of withdrawal
If you withdraw from this contract, you will be reimbursed for all payments you have made to us, including delivery costs (except for additional costs resulting from your possible choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than 14 days from the day we are informed of your decision to withdraw from this contract.Said reimbursements will be made using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a consequence of such reimbursement. Refunds may be suspended until receipt of the goods or until the consumer demonstrates that they have returned the goods, whichever is earlier. You are kindly requested to return the goods or deliver them to us or to (Dominosistemi srl - Via Renolda 37 - Castel Mella (BS) Tel 0302308677 - info@dominodisplay.com), without undue delay and in any case within 14 days from the day you informed us of your withdrawal from this agreement. The deadline is met if you return the goods before the expiry of the 14-day period. "The direct costs of returning the goods will be borne by you. " You are responsible only for the decrease in the value of the goods resulting from handling the goods other than what is necessary to establish the nature, characteristics, and operation of the goods.

STATEMENT OF ABSENCE OR EXCLUSION OF WITHDRAWAL

The right of withdrawal under Articles 52 to 58 for distance and off-premises contracts is excluded with respect to:

(b) the provision of goods or services whose price is linked to fluctuations in the financial market beyond the trader’s control and that may occur during the withdrawal period;
(c) the supply of custom-made or clearly customized goods;
(d) the supply of goods that are likely to deteriorate or expire rapidly;
(e) the supply of sealed goods that are not suitable for return for hygienic or health protection-related reasons and which have been opened after delivery;
(f) the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods;
(g) the supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales agreement, the delivery of which can be made only after thirty days and the actual value of which depends on fluctuations in the market that cannot be controlled by the trader;
(h) agreements where the consumer has specifically requested a visit by the trader for the purpose of carrying out urgent repair or maintenance work. If, in connection with such a visit, the trader provides services in addition to those specifically requested by the consumer or goods other than spare parts necessary to carry out maintenance or repairs, the right of withdrawal applies to such additional services or goods;
(i) the provision of sealed audio or video recordings or sealed computer software that have been opened after delivery;
(l) the supply of newspapers, periodicals and magazines with the exception of subscription contracts for the supply of such publications;
(m) contracts concluded at a public auction;
(n) the provision of housing for non-residential purposes, transportation of goods, car rental services, catering services, or services concerning leisure activities if the contract stipulates a specific date or period of performance;
(o) the supply of digital content by means of a non-material medium if performance has begun with the consumer's express agreement and their acceptance that they would then lose their right of withdrawal.

LIMITATION OF LIABILITY

DOMINO SISTEMI S.R.L. assumes no responsibility for any damages resulting from use or misuse of the service provided by www.dominodisplay.com. In no event shall DOMINO SISTEMI S.R.L., its representatives and employees, be liable to the User or anyone else.
DOMINO SISTEMI S.R.L. assumes no responsibility for errors and omissions within www.dominodisplay.com or any website that may be referenced or linked.
DOMINO SISTEMI S.R.L. reserves the right to continuously update the website www.dominodisplay.com which can be done at any time. The Information may contain inaccuracies of any kind or typographical errors.
DOMINO SISTEMI S.R.L. does not guarantee that the services performed by www.dominodisplay.com will be provided without interruption, this will be stated in advance except for causes beyond DOMINO SISTEMI S.R.L.'s control.
DOMINO SISTEMI S.R.L. is solely responsible for evaluating the accuracy, completeness, and usefulness of what is provided through the www.dominodisplay.com website.
DOMINO SISTEMI S.R.L. cannot accept any liability to the purchaser or any third party for any indirect, incidental, consequential, punitive or exemplary damages (including, without limitation, loss of profits, revenue, business opportunity) arising out of or in connection with a product or service provided by DOMINO SISTEMI S.R.L. or the use or inability to use the same.
DOMINO SISTEMI S.R.L. does not assume any responsibility for inefficiencies attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that would prevent, in whole or in part, the execution of the contract in the agreed time.
DOMINO SISTEMI S.R.L. shall not be liable to any party with respect to damages, losses and costs incurred as a result of the non-performance of the contract for the aforementioned causes, the Customer being entitled only to a refund of the price paid.
Without prejudice to cases of willful misconduct or gross negligence on the part of DOMINO SISTEMI S.R.L., it is agreed as of now that, if DOMINO SISTEMI S.R.L. is found to be liable for any reason to the Customer, including in the event of total or partial non-fulfillment of the obligations assumed by DOMINO SISTEMI S.R.L. towards the Customer as a result of the execution of an order, the liability of DOMINO SISTEMI S.R.L. shall not exceed the price of the Products purchased by the Customer and for which the dispute has arisen.

USER RESPONSIBILITY

The User is obliged to make sure that their entered data are true, complete, up-to-date and to promptly notify any changes to same. In the case of making false statements, the benefits obtained from the services provided will be lost. DOMINO SISTEMI S.R.L. reserves the right to remove such individuals from its user lists, after formal and unaccepted invitation for self-correction.

COPYRIGHT AND TRADEMARK

WHEREAS, on the pages of www.dominodisplay.com it is not intended to voluntarily reproduce any copyrighted or infringing material; whereas, also, for any original and protected material published on www.dominodisplay.com the source is cited, in case an infringement of copyrighted material is found, whichever party owns the same, it is necessary to notify the Staff of www.dominodisplay.com (via e-mail to info@dominodisplay.com) who will immediately investigate and resolve, upon ascertaining the situation, by removing such content. It should be noted that each product or product name and their description, each Denomination and its description, company, entity, people's names, trademark, or logo mentioned in this site are trademarks or documents belonging to their respective owners or holders and may be protected by patents and/or copyrights granted or registered by the appropriate authorities. PRIVACY

Pursuant to art.13 of Legislative Decree 196/2003 "Code for the protection of personal data" we inform the Customer that the processing of data provided to DOMINO SISTEMI S.R.L. when registering to this site has the primary purpose of registering the user and bring to a conclusion the sale transaction. The provision of data is optional, but a refusal to provide them results in the inability to perform the online shopping service.

The personal data provided are collected electronically and processed, including by electronic means, directly and/or through delegated third parties (home delivery, mailing and data entry companies) for the following purposes:
- Administrative management of orders and purchases;
- Management of any participation in loyalty programs
- Statistical purposes related to the detection of purchasing behavior
- Sending advertising materials related to products and offers through the use of newsletters, sms, mms.

In any case, DOMINO SISTEMI S.R.L. undertakes not to communicate or disseminate the data collected to subjects not necessary for the performance of the services mentioned above and to carry out processing that is not necessary, not relevant and not exceeding the contractual requirements . Pursuant to Art. 7 of Legislative Decree no. 196/2003, the Customer has the right to obtain confirmation of the existence or non-existence of personal data concerning them and the communication of same in an intelligible format. The Customer has the right to obtain indications
- regarding the source of the personal data;
- of the purposes and methods of processing;
- of the logic applied in the case of processing carried out with the aid of electronic instruments;
- of the identification details of the owner, managers and designated representative in accordance with Article 5 (2);
- of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity as designated representative in the territory of the State, as managers or appointees.

The Customer has the right to obtain:
- updating, rectification or, when interested, integration of data;
- the deletion, anonymization or blocking of data processed unlawfully, including data whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed;
- certification that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except where this proves impossible or involves the use of means manifestly disproportionate to the protected right.

They have the right to object, in whole or in part:
- for legitimate reasons to the processing of personal data concerning him/her, even if relevant to the purpose of collection;
- to the processing of personal data concerning him/her for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.

WARRANTY CONDITIONS

Product warranty is governed by the conditions dictated by the manufacturer, which the customer declares to know and accept in full.
However, the customer's mandatory rights under Italian law remain unaffected, and in particular, in the case of purchases by "Consumers" subjects, the rights and faculties provided for by Legislative Decree. September 6, 2005, no. 206, Consumer Code.
Domino Sistemi advises that users, should they consider activating the warranty, may contact the supplier at the Service Department at 030 2308623, or at one of the numbers listed on the Support page https://www.dominodisplay.com/assistenza-h24.

Domino Systems will open a Ticket, for which you will need to provide the following data:
- Order number
- First and Last Name
- Email
- Cell phone
- Reason for requesting assistance
- Describe the problem encountered
- Provide pictures of the fault found
- Serial Number and Model of the Faulty Device
- Invoice of Purchase of the Device
- Device installation address and on-site reference in case it is necessary to plan on-site intervention.

Domino Systems will forward the request to manufacturer support.
Notwithstanding the regulations of the law and the manufacturer's conventional warranty, Domino Sistemi hereby makes the user aware that:

1 - The warranty covers products or components that have manufacturing defects and operates only if, at the time of the request for such service, the warranty certificate is completed in all its parts and exhibited together with the invoice proving the purchase or the sales receipt. In addition, the serial number on the product must be legible.
2 - Authorized technical service centers are the only ones authorized to handle the warranty. The warranty does not cover reimbursement for repairs made by unauthorized service centers. Any work and any damage done to the products by the work of unauthorized service centers will not be covered by warranty.
3 - The product warranty will immediately expire if the product is modified and adapted to technical and safety regulations other than those in force in the country for which product was designed and manufactured.

4 - Warranty does not cover:
(a) Periodic inspection, maintenance, repair or replacement of parts subject to wear and tear.
(b) Costs related to transportation, moving or installation of the product.
(c) Misuse, incorrect use or improper installation.
d) Damage caused by improper use and attempted repair or tampering by unauthorized personnel, damage caused by fire, water, natural phenomena, war, public motions, improper power supply, insufficient ventilation, accidental falls, and all forms of carelessness. The warranty also does not cover monitors in which software other than that originally installed by the manufacturer has been installed.
Without prejudice to the full reference to the conditions of the manufacturer's warranty, the customer, in particular, declares himself to be aware that in the event of warranty work, the service will not assume in any way costs and responsibilities related to the uninstallation of the monitor that is:
- fixed at a height of more than 1.60 m.
- located within specific furnishings.
- in VideoWall configuration
- 65" or larger in size.

In such cases, it will be the sole responsibility of the user to arrange at their own expense for the placement of the product on the ground prior to site intervention.
The customer further acknowledges that all liquid crystal display (LCD) screens, of all brands, are subject to decrease in brightness over time.
The warranty applies to any person who takes formal possession of the product during the warranty period.
